Terms of Service

Last updated

These terms apply when you use Braivo’s hosted service: the console at braivo.app, schools’ learning sites at <school>.braivo.app, and Braivo’s connection for AI apps. Braivo is operated by Kriasoft di Konstantin Kutepov, Via Luigi Vanvitelli 14, 63822 Porto San Giorgio (FM), Italy, VAT number IT02560680445. By signing in, you agree to these terms; our Privacy Policy explains how we handle personal data.

Beta, and free

Braivo is in beta. It changes often, may have errors, and may be unavailable at times. It is free during the beta. If we introduce fees, we will tell you at least 30 days before, and nothing will be charged without your agreement.

Your account

You sign in with a code sent to your email, or with Google. Keep your email and Google account secure: whoever can read the one or use the other can sign in as you. An account is for one person. To set up or manage a school, you must be at least 18; learners younger than that use Braivo through their school.

Schools

If you set up or manage a school, or any organisation, on Braivo, you confirm you may act for it and accept these terms on its behalf. The school is responsible for the material it adds, for having the rights to use it, and for having a lawful basis, and any consent the law requires, for its learners’ data, minors’ included.

Your material

You, or your school, keep ownership of the material you add and the work learners do. You let Braivo store, process and show it only as needed to provide the service, including sending it to the providers named in the Privacy Policy when you use features that rely on them.

Processing schools’ data

For a school’s material and its learners’ data, the school is the controller and Braivo its processor. These terms are the data processing agreement between them (GDPR, Article 28):

  • We process the data only to provide Braivo, as the school uses it and instructs us, unless the law requires otherwise, in which case we tell the school first where allowed.
  • The data is that described in the Privacy Policy, of the school’s members and learners, for as long as the school uses Braivo.
  • Only people who need to, and who are bound to confidentiality, can access it, and we protect it as the Privacy Policy describes.
  • The school authorises the subprocessors named in the Privacy Policy. We bind each to obligations like these, and announce a new one there at least 30 days before it starts, so the school can object, or leave if we cannot agree.
  • We help the school answer people’s requests about their data, keep it secure, and handle a breach, telling it without undue delay once we learn of one.
  • When the school leaves, we return its data on request and delete it within 30 days, and from backups within a further 14.
  • We tell the school at once if we believe an instruction breaks data protection law, and help it with data protection impact assessments and consultations with its authority.
  • We give the school the information it needs to show these obligations are met, and allow and contribute to audits, including inspections, by the school or an auditor it mandates, on reasonable notice.

AI can be wrong

Braivo’s AI, and AI apps you connect, can be wrong. Review what they draft before you publish it: learners see only what has been published in Braivo.

Connected AI apps

An AI app you connect, such as ChatGPT or Claude, is run by its provider under that provider’s terms. It acts as you, and you are responsible for what you ask it to do in Braivo. What it reads from Braivo goes to that provider. You can disconnect it at any time (see Support).

Acceptable use

Do not use Braivo to:

  • break the law, or infringe others’ rights, including copyright and privacy;
  • reach a school, account or data you have not been given access to;
  • disrupt, overload or probe the service, or get around its limits;
  • upload malware, or content harmful to learners.

Testing Braivo’s security in good faith is welcome when you follow our reporting process.

Open source

Braivo’s platform is open source under the AGPL-3.0-only licence. That licence governs the code; these terms govern the hosted service.

Ending

You can stop using Braivo at any time, and ask us to delete your account or your school (see Support). We may suspend or close an account or school that breaks these terms, telling you why where we can; except for a serious breach, we give a school 30 days’ notice to fix it or take a copy of its data. If we stop offering Braivo, we will tell account holders at least 60 days before, and give schools a copy of their data on request.

Liability

Braivo is in beta, as described above. We are liable to you as Italian law provides, and these terms take away none of the rights consumers have under mandatory law.

Governing law

These terms are governed by Italian law, and the courts competent under it decide disputes. If you are a consumer, you also keep the protection of the mandatory law where you live, and the right to bring and answer a claim in the courts there.

Changes

We will post changes here, with a new date above, and email account holders about significant ones at least 30 days before they take effect. If you do not accept them, you can stop using Braivo before then; using it afterwards means you accept them.
